Prayer: Writ Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus, directing the respondents to correct the petitioner's Date of Birth as 30.08.1963 instead of 15.05.1962 in the service records maintained by the 3rd respondent by considering his appeal dated 09.08.2019.

The relief sought for in the present Writ Petition is to direct the respondents to correct the petitioner's Date of Birth as 30.08.1963 instead of 15.05.1962 in the service records maintained by the 3rd respondent by considering his appeal dated 09.08.2019.

2. The learned counsel for the petitioner made a submission that the petitioner has preferred an appeal in this regard to the 2nd respondent on 09.08.2019. Alteration of Date of Birth has to be considered strictly in accordance with rules in force. If at all the application / appeal has been submitted in accordance with the rules in force, then the said application / appeal has to be considered on merits and in accordance with law.

3. This being the procedures to be followed, without going into the merits of the matter, the respondents are directed to consider the appeal filed by the Writ Petitioner on 09.08.2019 and pass appropriate orders on merits and in accordance with law, within a period of 12 weeks from the date of receipt of a copy of this order.

4. With the above direction, the Writ Petition stands disposed of. No costs.
