O R D E R

The instant writ petition has been filed with a prayer for issuing a Mandamus, to direct the respondent to pay 10% interest for the belated 1/5

payment of terminal benefits such as Provident Fund and Gratuity to the Petitioner.

2. The case of the petitioner is that he was working as a driver in the respondent corporation from 26.12.1983. After completion 35 years of service, he retired from service on 31.04.2023.

3. The grievance of the petitioner is that the retirement benefits such as Gratuity and Provident Fund were disbursed only on 12.02.2025, but, no interest was paid on belated payment. The petitioner in this regard had made a representation to the respondent on 11.03.2025. Since the same did not evoke any response, the present writ petition has been filed before this Court.

The learned Standing Counsel for the respondents would fairly concede that in view of the similar orders passed by this Court in W.P.Nos 40031, 33742 and 35806 of 2024, they are willing to pay the interest at the rate of 6% per annum for the belated payment of the eligible and admissible amount.

5. Heard the learned counsel for both sides and perused the materials available on record.

In view of the above submission of the learned Standing Counsel, this Court deems it appropriate to direct the respondent to pay the interest at the rate of 6% per annum from the date of retirement till the date of actual disbursal of the terminal benefits to the petitioner, within a period of six weeks from the date of receipt of a copy of this order.

7. In the result, this Writ Petition is disposed of with the above observations. No costs.
