O R D E R

The grievance of the petitioner is that while he was working in the capacity of Assistant Elementary Educational Officer under the Control of the Director of Elementary Education, he had contributed an amount of Rs.5,96,893/- towards the TPF Account. But now the petitioner having been promoted as Head Master in Government High School, Krishnagiri District, he has been assigned with a GPF account. After his such appointment, he has made representation on 25.07.2018 to the respondents to transfer his such TPF amount to GPF account. Since no response is forthcoming, the petitioner came forward to file this writ petition seeking for a direction to consider his representation.

2. The learned counsel appearing for the petitioner submits that the writ petition may be disposed of without seeking any reply affidavit, inasmuch as in the absence of reply affidavit of the respondent if the prayer is allowed, the same is going to cause no prejudice to them.

The learned counsel appearing for the respondents submits that since the representation has been filed only in the recent past, this Court should not issue a writ of Mandamus, inasmuch as the respondents cannot be said to be guilty of inaction and hence, prays for dismissal of this writ petition. 4.

Regard being had to the facts and circumstances of this case, especially the nature of relief sought for, this Court disposes of this writ petition with a direction to the respondents to consider such representations of the petitioners, in accordance with law, within a period of four weeks from the date of receipt of copy of this order. However, it is made clear that this order should not be treated as a mandate of this Court to dispoe of the representation in any particular manner, inasmuch this Court has not examined the merit of such representation.

With the aforesaid direction, this writ petition stands disposed of. No costs.
