(CRIME NO.190/2022) For Petitioner : M/S G.BALASUBRAMANIAM Advocate For Respondent : MR.A.DAMODARAN, Additional Public Prosecutor, PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the offences publishable under Sections 379, 467 and 468 of IPC, in Crime No.190 of 2022 on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that the de-facto complainant is working as Interpreter in the VI Metropolitan Magistrate Court, Egmore. On 02.05.2022, after completion of her calling work, she found that one official seal which was kept under the table was missing. After enquiry with the colleagues and after seeing the CCTV footages, it was found that one Vivekanandan (A1), who is the suspended court staff had stolen the seal from the table. Based on the complaint given by the de-facto complainant, a case has been registered against him.

3. The learned counsel for the petitioner submitted that the petitioner did not commit any such offence as alleged by the prosecution and he has been falsely implicated in this case. Hence, he pleads for grant of anticipatory bail to the petitioner. https://hcservices.ecourts.gov.in/hcservices/

4. The Additional Public Prosecutor submitted that there are totally three accused in this case. A1 is the court staff, who had already been suspended from service; A2 is an Advocate and A3 is the petitioner, who is working as Dwali. Insofar as the petitioner is concerned, he had only identified the seal from the Court and helped A2 and A3 to steal the seal. Hence, he vehemently opposed to grant anticipatory bail to the petitioner.

5. Considering the serious nature of allegation made against the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner.
