Petitions filed under Article 226 of the Constitution of India to issue a Writ of Mandamus to forbearing the respondents 1 & 4 from constructing or using the panchayat road comprised in Survey No.301 as burial or burning ground in contravention of Tamil Nadu Village Panchayat (Prohibition of Burning and Burial Ground) Rules, 1999.
For Petitioners : Mr.R.Rajarajan in both W.Ps For Respondents : Mr.A.Anandan, GA, for R1 to R4 in both W.Ps : Mr.N.Manokaran, for R5 & R6 in both W.Ps C O M M O N O R D E R The petitioners have filed these writ petitions seeking issuance of a Writ of Mandamus to forbear the respondents 1 & 4 from constructing or using the panchayat road comprised in Survey No.301 as burial or burning ground in contravention of Tamil Nadu Village Panchayat (Prohibition of Burning and Burial Ground) Rules, 1999.
2. Today, when the matter is taken up for hearing, learned Government Advocate appearing on behalf of the official respondents submitted that pending the Writ petitions, the District Administration passed an order dated 11.11.2019 and classified a portion of the disputed land comprised in S.No.301 as Burial ground.
3. In view of the above submission, recording the said statement, no further order is necessary. Accordingly, these Writ Petitions are closed. However, petitioners are at liberty to challenge the said order in the manner known to law. No costs. Consequently, connected Miscellaneous petitions are closed.
