ORDER

The petitioner, who was arrested and remanded to judicial custody on 02.10.2025 for the alleged offences under Sections 8(c) r/w 22(b), 22(C) and 29(1) of Narcotic Drugs and Psychotropic Substances Act, 1985, in Crime No.645 of 2025 on the file of the respondent police, seeks bail.

The case of the prosecution is that based on information, the respondent police recovered 10 grams of Methamphetamine from the possession of A1 and based on his statement, further search was conducted and 65 grams of Methamphetamine was recovered and the petitioner was arrested and remanded to judicial custody. Hence, the case was registered.

The learned counsel appearing for the petitioner would submit that the petitioner has been remanded to judicial custody on 01.10.2025 and she has been falsely implicated in this case based on the statement of A1 and nothing was recovered from her directly. The learned counsel further submitted that the petitioner is willing to abide by any condition that may be imposed by this Court and he will not tamper the witnesses and he is ready to furnish the solvent sureties. Hence, he prays to grant bail to the petitioner.

4. The learned Government Advocate (Crl.Side) appearing for the respondent would submit that recovery from the petitioner is 65 grams of Methamphetamine, which is a commercial quantity. It is further submitted that the petitioner has got two previous cases. Hence, he opposed to grant bail to the petitioner.

5. Considering the submission of the learned counsel on either side and taking into consideration the recovery of commercial quantity of contraband and

also the past conduct of the petitioner, this Court is of the firm view that this is not an appropriate stage to consider the bail petition of the petitioner. Hence, this Court is not inclined to grant bail to the petitioner.
