(The case has been heard through video conference) The learned counsel appearing for the petitioner would submit that the petitioner was arrested on 22.04.2020 in this case and he is in custody for more than 90 days. He would further submit that the charge sheet has not been filed. Hence, he seeks permission of this Court to withdraw this petition with liberty to file a petition under Section 167(2) Cr.P.C., before the court below. 2.In view of the above submission so made by the learned counsel for the petitioner, this Criminal Original Petition stands dismissed as withdrawn.
