This petition is filed to condone the delay of 35 days in preferring the above Second Appeal.

2. Though notice is served on the 1st respondent, none appears before this Court.

3. The learned counsel for the 2nd respondent has no serious objection to the delay being condoned.

4. I have gone through the affidavit filed in support of this petition and I am satisfied with the reasons stated therein. Therefore the delay of 35 days in preferring the above Second Appeal is condoned.

5.Accordingly, this petition is ordered.

Registry is directed to number the Second Appeal, if it is otherwise in order and further directed to print the name of the 2nd respondent counsel.
