This petition is filed under Section 482 of Criminal Procedure Code to call for records and quash the proceedings in P.R.C.No.34 of 2009 on the file of the Judicial Magistrate, Ambattur.

ORDER

This Criminal original petition has been filed challenging the proceedings pending against the petitioner in PRC No.34 of 2009 on the file of the learned Judicial Magistrate, Ambattur.

2. When the matter came up for hearing in the earlier occasion, none appeared on behalf of the petitioner. The learned Government Advocate appearing for the first respondent submitted that the present criminal original petition was filed in the year 2009 when the case was pending before the Judicial Magistrate, Ambattur, in P.R.C.No.34 of 2009. But, the case is now committed to the Court of Sessions and pending before the Principal Sessions Court, Thiruvallur, in S.C.No.50 of 2013. He further submitted that charges have also been framed and the matter is now posted for trial. However, as there was no representation for the petitioner, this Court adjourned the matter under the caption 'for dismissal'.

3. Even today, ie., on 06.12.2018, none appeared on behalf of the petitioner, despite the matter is posted under the caption 'for dismissal'. Under the above circumstances and also taking note of the subsequent developments, as has been submitted by the learned Government Advocate, this Court is inclined to dismiss the present criminal original petition and the same is accordingly, dismissed.
