ORDER
This petition has been filed seeking a direction to directing the Respondent to dispose the representation made by the petitioner on 29.02.2024
that the petitioner is only entitled for the leasehold right over Plot No F-87 in SIPCOT Industrial Complex Gummidipoondi.
2. It is the case of the petitioner that originally the petitioner's grandfather along with his brothers were running an ancestral business of retail sale of petrol and Diesel in the name of V.M.Samy and sons on partnership among the male members without any formal partnership agreement. The order of allotment of industrial plot by the respondent Corporation in favour of the petitioner on 10.08.1988. The execution of lease deed between the respondent corporation and M/s.Sekar Enterprises on 18.07.1989. The judgment in OS.No.59/2007 by the learned District Munsif court, Ponneri dismissing the suit by one Thulasingam in favur of one V.T.Rajhashekher the father of proprietor of the petitioner on 27.07.2007. The judgment delivered in AS.No.12/2008 dated 06.02.2009 confirming the decree in OS.No.
59/2007 of the District Munsif court, Ponneri by the appellate Court viz., Sub court at Ponneri in favour of the petitioner on 27.07.2007. The order of High Court dated 24.01.2018 in WP.No.4297 of 2017 dismissing the writ petition filed by one Thulasingam, grandfather of the Proprietor of petitioner for declaration that the petitioner in the said writ petition is the sole proprietor of the business as dealer of Bharat Petroleum Corporation. The deed of Retirement dated 25.08.2014 executed by one Thulasingam then Partner of M/s.
M/s.Sekar Enterprises. The letter of reconstitution of M/s.Sekar Enterprises to retail outlet dealership represented by the proprietor of the petitioner dated 30.03.2022 by Bharat Petroleum Corporation Limited. Representation of the petitioner for declaration that M/s.Sekar Enterprises is only entitled for lease hold right over plot No.F87 Sipcot Industrial Complex, Gummidipoondi dated 29.02.2024. The said representation received on 04.03.2024 by the respondent SIPCOT, but till no order is passed. Hence, the present writ petition.
3. The learned counsel for the petitioner submitted that this Court may direct the respondents to consider and pass orders on the petitioners representation within the stipulated time as fixed by this Court.
4. The learned counsel appearing for the respondent submitted that the representation will be considered and orders will be passed within the stipulated time as fixed by this Court.
5. Heard the learned counsel for both side and perused the materials available on record.
6. Considering the facts and circumstances of the case and in view of the limited request sought for by the petitioner, this court directs the respondent to consider and pass orders on the petitioner's representation dated 29.02.2024 within a period of four weeks from the date of receipt of a copy of this order.
