Respondents Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus to direct the respondents to consider and pass orders on the application of the petitioner dated 17.05.2013 followed by the compliance report dated 23.03.2015 for granting recognition to the petitioner School for standards 11 and 12 upto the academic year 2015-16 in the light of the judgments of this Honourable Court in W.P.(MD).No.11031 of 2012 and W.P.(MD) No.20329 of 2014.

By consent, the writ petition is taken up for final disposal.

2. The petitioner would state that School was started in the year 2001-2002 after obtaining necessary permission from the second respondent by proceedings dated 27.12.2001 to conduct classes from VI to IX standard and temporary recognition was also granted. Thereafter, on 17.3.2003, permission was granted to conduct X standard . The petitioner would further state that on 24.03.2008, temporary permission was granted to run XI and XII standard (+1 and +2) and the petitioner has applied for necessary permission to make it permanent and also complied with all the requirements. Now, the petitioner has come forward with this writ petition praying for appropriate direction, directing the second respondent to pass orders on the application dated 17.5.2013 submitted by the petitioner for recognition as expeditiously as possible.

Mr.Kandhan Duraisami, learned counsel for the petitioner would submit that after submission of application, certain defects have been pointed out and it has been duly complied with by the petitioner through compliance report dated 23.03.2015 and would further submit that in the light of the order dated 06.04.2015 made in W.P.(MD).No.20329/2014, there cannot be any impediment on the part of the second respondent to consider the application submitted by the petitioner for permanent recognition for Higher Secondary Classes (XI & XII standard), and pass appropriate orders within the stipulated time.

4. This Court heard the submission of Mrs.P.Rajalakshmi, learned Government Advocate, who accepts notice on behalf of the respondents.

5. This Court, taking into consideration, the limited scope of the prayer sought for by the petitioner, without going into the merits of the claims projected by the petitioner, directs the second respondent to consider and dispose of the petitioner's application dated 17.05.2013 as well as the compliance report dated 23.03.2015 and the official may also take note of the order dated 06.04.2015 made in W.P.M.P.No.20329/2014 and pass appropriate orders on merits and in accordance with law within a period of eight weeks from the date of receipt of a copy of this order and communicate the decision taken to the petitioner.
