The relief sought for in the present writ petition is to direct the respondents 1 and 2 to consider the petitioner's representation dated 07.09.2022 given in person and by post and consequently direct the 1st and 2nd respondents, to change Patta in petitioner's name with respect to 0.50 acres of land in S.No.31/8 and 0.50 acres of land S.No.31/9 in Seerapalayam Village, Mathukarai Taluk, Coimbatore District.
2. The petitioner states that he is the absolute owner of the property, which was originally assigned in favour of Mr.Rangan and Palanisamy and subsequently, the assignees sold the property in the name of other persons including the petitioner.
3. The grievance of the petitioner is that the application submitted by him for grant of patta has not been considered.
4. The Sale Deed was executed long back and in respect of such registrations, patta is to be obtained by submitting appropriate application in a prescribed format before the competent authority. The Tahsildar is the competent authority for grant of patta by conducting an enquiry and therefore, the petitioner is at liberty to submit a fresh application in the prescribed format to the Tahsildar, who is having jurisdiction and in the event of submitting such application, the Tahsildar concerned shall conduct an enquiry in the manner contemplated under the Patta Pass Book Act, 1983 and thereafter, decide the issues on merits and in accordance with law as expeditiously as possible.
