ORDER

This Writ Petition has been filed seeking a direction to the 4th respondent to provide police protection to the petitioners for the purpose of laying a fence in Survey No.228/1A, subdivided as Survey No.228/1A1 (Patta No.412), measuring an extent of 2.88 acres, situated at Kodipally Village, Krishnagiri District.

2. The petitioners claim title over the subject property by virtue of a registered sale deed dated 11.11.2024, registered as document No.4175 of 2024. Subsequently, the revenue records were mutated in the names of the petitioners. Thereafter, the property was surveyed, and when the petitioners attempted to put up a fence around the property, the same was objected to by the respondents 5 and 6.

3. It is submitted that the respondents 5 and 6 are also claiming title over the subject property. In this regard, the respondents 5 and 6 have filed a suit for declaration in O.S.No.695 of 2024 before the Principal Sub Court, Krishnagiri and the same is pending adjudication.

4. Since the title to the property is under dispute between the petitioners and the respondents 5 and 6, this Court is not inclined to grant police protection for fencing the property, as the same would indirectly amount to deciding possessory rights in a disputed civil matter.

5. In view of the above, this Writ Petition (Criminal) stands dismissed. However, it is open to the petitioners to work out their remedy before the competent Civil Court and upon succeeding before the Civil Court, approach the jurisdictional police for appropriate protection, if required.
