ORDER : The Court Made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the offences publishable under Sections 8(c), 20(b)(ii)(B) and 28 of NDPS Act in Crime No.85 of 2022 seeks anticipatory bail.
2. Totally there are five accused and the petitioner herein is arrayed as A4. The case of the prosecution is that, based on the information, the police personnel have conducted a raid in the Play Ground near Thidir Nagar, in which A1 to A3 were found in possession of 4kgs Ganja and selling the same in a two wheeler. The allegation against the petitioner is that, she along with the other accused had selling the Ganja.
3. The learned counsel for the petitioner submitted that this is the 2nd anticipatory bail petition. Earlier the petitioner had filed a petition seeking anticipatory bail in Crl.O.P.No.9308 of 2022 and the same was dismissed by this court vide order dated 27.04.2022. He further submitted that based on the confession of https://hcservices.ecourts.gov.in/hcservices/
co-accused, the petitioner has been implicated in this case. Hence, he sought for anticipatory bail to the petitioner.
4. The Additional Public Prosecutor submitted that already, A1 to A3 were arrested and they were remanded to judicial custody. He further submitted that from the date of filing of the First Information Report, the petitioner is absconding and there is no change of circumstances in this case, after dismissal of the earlier application.
5. Considering the facts and circumstances of the case and also taking into account the fact that there is no change of circumstances in this case, after dismissal of the earlier application, this Court is not inclined to grant anticipatory bail to the petitioner.
