This Criminal Miscellaneous Petition has been filed to modify the condition imposed on the petitioner while granting bail by this Court in Paragraph No.7 of the order dated 30.03.2023 made in Crl.O.P.No.7123 of 2023 filed in respect of Crime No.2 of 2023 on the file of the respondent police.

2.The learned Counsel for the petitioner would submit the petitioner was arrested on 23.02.2023 in Crime No.2 of 2023. The petitioner had applied for bail before this Court in Crl.O.P.No.7123 of 2023 and this Court vide order dated 30.03.2023 was pleased to grant bail with a direction "to deposit the original title deeds of an immovable property not less than the value of Rs.25 lakhs (which stands in the name of the petitioner or her relatives or her friends) to the credit of Crime No.2 of 2023". He would submit that despite earnest steps taken by the petitioner, neither the petitioner nor her relatives is not able to deposit the original title deeds of immovable property for Rs.25 lakhs. gbi also paid an amount of Rs.41 lakhs to the society. He would submit that more than 60 days have elapsed and the respondent police has also not filed the final report till date and, therefore, the petitioner is also entitled to bail under Section 167 (ii).

Considering the said submission, the condition No.7 imposed by this Court in Crl.O.P.No.7123 of 2023 dated 30.03.2023 is modified to the effect that "the petitioner is ordered to be released on bail on her executing a bond for a sum of Rs.15,000/- (Rupees Fifteen Thousand Only) with two sureties, for a like sum to the satisfaction of the learned Judicial Magistrate No.IV, Coimbatore". The all other conditions shall remain unaltered. 4.With the above directions, this criminal miscellaneous petition is ordered.
