BHARATHA CHAKRAVARTHY CRIMINAL MISCELLANEOUS PETITION No.7100 of 2022 IN CRL.RC.No.66 of 2022 K.NALLASAMY [ PETITIONER ] Vs M.ELANGO [ RESPONDENT ] Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to modify the condition imposed in para 5 (a) the petitioner accused is ordered to be relesed on bail, on his executing a bond for a sum of Rs.10,000/- (Rupees ten thousand only) with tow sureties, of whom, one should be a blood relative, each for a like sum to the satisfaction of the Judicial Magistrate, Fast Track Court No.

I, Erode, within 15 days from the date of commencement of the courts normal functioning, failing which the bail granted by this Court shall stand dismissed automatically and on further conditions that order dated 27.01.2022 made in Crl.M.P.No.645 of 2022 in Crl.R.C.No.66 of 2022 on the file of this Honorable High Court by allowing this petition. Order : This petition coming on for orders upon perusing the petition and the filed in support thereof and upon hearing the arguments of M/S.M.GURUPRASAD, Advocate for the petitioner the court made the following order:- This petition has been filed to modify the condition imposed in Crl.M.P.No.645 of 2022 in Crl.R.C.No.66 of 2022, that one of the two sureties should be a blood surety.

2. The learned counsel for the petitioner would submit that, there is no blood relative with a value, who can be produced before the Court.

3. Therefore, considering the fact that 50% of the cheque amount has already been deposited, the condition imposed in para 5(a) i.e. one surety must be blood surety is modified as any surety, who need not necessary be a blood surety. Further, time is extended for a period of 10 days from the date of receipt of copy of this order to comply with the order.

4. With the above direction, this Criminal Miscellaneous Petition is ordered.
