The affidavit filed by the petitioner in Court seeks to suggest that the Committee, which had gone into the issue earlier, had recommended shifting and that has not taken place. It is further stated that the land use as per master plan does not permit the activity going on.

2.Learned counsel appearing for the fifth respondent states that the activity of tyre retreading is no more located in the area and only re-conditioning of the buses takes place. He submits that as stated by the Tamil Nadu Pollution Control Board / first respondent, all environmental parameters are met. He requests for a short time to file an affidavit setting out the situation as on date and how the oil-drain from the bus is dealt with. In all these behalfs, relevant photographs be also filed along with the affidavit. The affidavit be filed within two (2) weeks.

4.The fourth respondent to also file an affidavit within two (2) weeks dealing with the issue of the master plan and the permissible user of the land as set out in the affidavit filed in Court today. The needful be done within the same time period of two (2) weeks.
