This petition has been filed seeking permission to recognize the power agent of the plaintiff and to allow the power agent to conduct the proceedings on behalf of the plaintiff.

2. The learned counsel for the applicant / plaintiff submitted that except D3 and D5 notice have been served upon other defendants. It is further submitted that D3 and D5 did not make their appearance and hence notice can be dispensed against them.

3. Considering the submission of the applicant, notice against R3 and R5 who are D3 and D5 in the suit, is dispensed with.

4. There is no representation for the other respondents.

5. The applicant has produced the original power of attorney document executed by the plaintiff in favour of the power agent, P.Rupakumar and the same got adjudicated on 03.04.2023 at Sembium Sub Registrar Office, https://www.mhc.tn.gov.in/judis 1/2

vum Chennai-11. The power agent is the father of the plaintiff and the properties are family properties. Hence, without prejudice to the contention of the respondents /defendants with regard to the appreciation of the evidence given by the power agent, the petition is allowed.
