O R D E R
The petitioner/accused, who was arrested and remanded into judicial custody on 28.02.2022 by the respondent police in connection with the case registered under Sections 8(c) r/w 20(b)(ii)(C) of NDPS Act in Crime No.58 of 2022, seeks bail.
2.The case of the prosecution is that 22kgs of ganja from six persons was recovered on 28.02.2022 in the public place. As far as this petitioner is concerned, it is alleged that he is found in possession of 4 kgs of ganja. The petitioner was arrested on 28.02.2022 and till date, final report was not filed. 3.Taking into consideration that the period of incarceration and non-filing of the fianl report, this Court is inclined to grant bail to the petitioner on the following conditions:- 4.Accordingly, the petitioner is ordered to be relased on bail subject to the following conditions:-
(a)the petitioner shall execute a bond for a sum of Rs.50,000/- (Rupees fifty thousand only) with two sureties, each for a like sum to the satisfaction of the learned Special Judge for EC/NDPS Act Cases, Salem;
(b)the sureties shall affix their photographs and Left Thumb Impression in the surety bond and the learned Magistrate may obtain a copy of their Aadhar Card or Bank Pass Book to ensure their identity; (c)the petitioner shall report before the Investigating Officer as and when required for interrogation;
(d)the petitioner shall not tamper with evidence or witness either during investigation or trial;
(e)on breach of any of the aforesaid conditions, the learned Judicial Magistrate/Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the conditions have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji v. State of Kerala [(2005) AIR SCW 5560];
(f)if the accused thereafter absconds, a fresh FIR can be registered under Section 229A IPC.
