The petitioner who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 341, 294(b), 392, 397 and 506(2) of IPC in Crime No.163 of 2022, seeks anticipatory bail.

The case of the prosecution is that on 21.04.2022, when the defacto complainant on the way to his home, the petitioner intimidate him by pointing the knife and stolen a sum of Rs.3,500/- from his pocket. The petitioner also threaten the general public by showing knife and escaped from that place. Hence, the complaint.

3. The learned counsel appearing for the petitioner would submit that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution. Hence, he prays to grant anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl. Side) appearing for the respondent police would submit that the petitioner robbed a sum of Rs.3500/- from the defacto complainant at knife point and also threatened the general public. Further this is the third anticipatory bail petition and the petitioner is having 11 previous cases as against him. Hence, he vehemently opposed to grant anticipatory bail to the petitioner.

5. It is seen that this Court already dismissed the earlier anticipatory bail petitions filed by the petitioner on two occasions and there is no change in circumstances. Further the petitioner has committed grave offence as against the society. Considering the facts and circumstances and also the gravity of offence committed by the petitioner, this Court feels that the custodial interrogation of the petitioner is very much required in this case. Hence, this Court is not inclined to grant anticipatory bail to the petitioner. The respondent Police is at liberty to secure the petitioner and proceed in accordance with law.

6. Accordingly, the Criminal Original Petition stands dismissed. 03.07.2024 rts
