Heard both sides.

2. The petitioners in this review application sought to introduce a case as if the respondent / writ petitioner having exercised

his option to continue to work under the first petitioner, is not entitled to claim the benefits of promotion on the strength of his seniority in the first petitioner department.

3. Learned counsel for the respondent / writ petitioner would at this juncture draw the attention of this Court to para 9 of the order, wherein the same issue is raised and discussed and decided against the department. This Court has dealt with the issue on the earlier occasion and rejected the contention of the Education Department in this regard and categorically held that the respondent / writ petitioner was, while working under the second petitioner department, having lien over his seniority in the first respondent department. That being so, no new ground is made out before this Court to entertain the review application and the order passed on 26.3.2014, warrants no review. The review application is hence dismissed. No costs.
