This Criminal Miscellaneous Petition has been filed seeking to suspend the sentence imposed on the petitioner vide judgement dated 28.12.2022 in S.C.No.17 of 2022 by the Sessions Judge, Magalir Neethimandram, Allikulam, Chennai and enlarge the petitioner on bail, pending disposal of the appeal.
2. The deposition of P.W.6, who is the Manager of a Co-operative Society, wherein, the robbed jewells were pledged, is Corroborating with other evidences. Since we do not find any evidence to consider the case of the petitioner for suspending the sentence, the other grounds raised by the petitioner have to be considered during the hearing of the appeal. Since there is no acceptable ground for the purpose of grant of suspension of sentence, we are not inclined to entertain the petition. Accordingly, the Criminal Miscellaneous Petition stands dismissed. List the Criminal Appeal after two weeks.
