ORDER

This writ petition has been filed for direction directing the respondents 1 to 3 to conduct enquiry upon representation dated 18.03.2024 made by the petitioner herein for the irregularities taken place in tender process in notification dated 29.02.2024 for Anaithu Grama Anna Marumalarchi ThitamII, 2024- 2025 (AGAMT).

2. Heard both sides and perused the materials available on record.

3. It is seen that on receipt of the complaint, the Assistant Executive Engineer was appointed as Enquiry Officer and conducted enquiry and rejected the complaint lodged by the petitioner, by an order dated 23.04.2024 on the ground that the auction was conducted in a proper manner in accordance with law.

4. However, the learned counsel for the petitioner submitted that the application was submitted by the petitioner before the second respondent and the second respondent is the competent authority to enquire into it.

5. In view of the above, the second respondent is directed to issue notice to the petitioner and the counter parties if any and conduct enquiry and after giving an opportunity of hearing to them, pass appropriate orders on merits and in accordance with law, within a period of twelve weeks from the date of receipt of a copy of this order.

6. With the above directions, this writ petition is disposed of. Consequently, connected Miscellaneous petition is closed. There shall be no order as to costs.
