ORDER : The Court Made the following order :- The petitioner/accused, who was arrested and remanded to judicial custody on 01.04.2022 for the offence punishable under Sections 294 (b), 342, 506(1), 307 of IPC and under Sections 5(l) 5 (m), 6, 9(l), 9(m), 10 of POCSO Act and Section 75 of Juvenile Justice Act, 2015 in Crime No.6 of 2022 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the petitioner is working as a Maths teacher and also Assistant Head Master in the school, misbehaved with some of the students, who are studying in 5th standard, aged about 10 to 11 years. Hence, the complaint.

3. The learned counsel for the petitioner would submit that the petitioner, who is working as a Maths teacher, falsely alleged that he misbehaved with his own students due to previous enmity. That apart, the petitioner was arrested and remanded to judicial custody on 01.04.2022.

4. The learned Additional Public prosecutor would submit that there are totally 15 minor victim girls and the petitioner misbehaved with them. One of the student gave a statement under Section 164 and it revealed that the petitioner committed a very serious offence as against his own students that too 10 to 11 years old. The teacher should not involved in this type of crimes and he must be a role model to all the students. Hence, he vehemently opposed for grant of bail to the petitioner..

5. Considering the nature of the allegation against the petitioner, the submissions made on either side and that in view of the serious offence committed by the petitioner as against the minor victim girls, this Court is not inclined to grant bail to the petitioner.
