PRAYER: Contempt Petition is filed under Section 11 of the Contempt of Courts Act, to punish the respondents herein for committing contempt of court for willful disobedience of the order passed by this Court made in writ petition W.P.No.26064 of 2024, dated 04.09.2024 by not considering the petitioner's representation dated 16.01.2025. O R D E R
When the contempt petition is taken up for hearing, it is submitted by the learned Government Advocate appearing for the respondents that pursuant to the direction issued in the main writ petition, the 2nd respondent herein passed an order on 12.09.2025 in Order No.12525/A1/2023.
2. When a specific question was put to the learned Government Advocate appearing for the respondents with regard to delay in complying the direction issued by this Court, by taking this Court to the affidavit filed by the 2nd respondent, dated 06.10.2025, the learned Government Advocate 2/4
would submit that immediately after the order was passed by this Court, a notice was issued to the petitioner on 23.09.2024 fixing the date of enquiry as 01.10.2024. The petitioner belatedly submitted his explanation on 11.11.2024. Thereafter, Incumbent Officer has been transferred and new person has taken charge. Therefore, due to this administrative reasons, there was some delay in complying the direction issued by this Court.
3. Accepting the reasons assigned in the affidavit filed by the 2nd respondent, dated 06.10.2025, the contempt petition is closed. If the petitioner is aggrieved by the order passed by the 2nd respondent herein on 12.09.2025 in Order No.12525/A1/2023, it is for him to challenge the same in the manner known to law.
