Respondents Prayer: Petition under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus, directing the respondents to pass appropriate orders for granting Family Pension in favour of the petitioner on the demise of her husband R.Gunasekaran from the post of Village Administrative Officer, Ethapattu Village, Ginjee Taluk, Villupuram District, based on the representation submitted by the petitioner dated 13.07.2015 with all consequential and other attendant benefits, within a time frame to be fixed by this Court.

ORDER

The husband of the petitioner was earlier employed as a Village Karnam prior to 14.11.1980 and he lost his job due to the abolition

of the post of Village Officers based on ordinance issued by the Government of Tamil Nadu. Subsequently, the husband of the petitioner was appointed as a Noon Meal Organizer in Villupuram District on consolidated pay on 08.02.1983. He was brought into regular time scale of pay in May 1994. According to the petitioner, her husband was appointed as a Village Administrative Officer on 02.11.2005. While working as Village Administrative Officer in Ethapattu Village, Ginjee Taluk, the petitioner's husband suddenly expired on 21.11.2014.

2. The grievance of the petitioner is that she is not settled with DCRG and Family Pension. In these circumstances, she made a representation dated 13.07.2015 to the second respondent to settle her DCRG and family pension.

3. Learned counsel appearing for the petitioner has sought permission to make a fresh representation to the second respondent and the second respondent could be directed to dispose of the same within a stipulated period.

4. In view of the narrow prayer made, the Writ Petition is disposed of, permitting the petitioner to make a fresh representation to the second respondent setting out her grievance relating to nonpayment of DCRG and family pension due to the death of her husband, and on receipt of such representation, the second respondent is directed to pass orders thereon, on merits and in accordance with law, within a period of six weeks from the date of receipt of a copy of this order. No costs.
