2.This writ petition has been filed, challenging the impugned order dated 22.12.2025 passed by the first respondent, closing the petitioners' application. 3.The said application was filed on the ground that the first petitioner is eligible to fall under the IDLS scheme. The petitioners have also stated in this writ petition as to how the first petitioner falls under the IDLS scheme. 4.The petitioners have challenged the impugned order on the ground that it is a non-speaking order. As seen from the impugned order, no reasons have been assigned for closing the first petitioner's application. The impugned order dated 11.12.2025 reads as follows:
'Greetings from National Single Window System (NSWS). Your License Application for approval Integrated Development of Leather Sector Scheme is closed. Kingly log into your NSWS Investor Portal for details.'
5.As seen from the same, no reasons have been given for closing the said application. A categorical statement has been made by the petitioners with the aid of supporting documents that they fall under the IDLS scheme. Being a nonspeaking order, necessarily, the impugned order dated 22.12.2025 passed by the first respondent has to be quashed and the matter has to be remanded back to the first respondent for fresh consideration, on merits and in accordance with law. 6.Mr.R.Sidharth, learned Central Government Standing Counsel accepts notice on behalf of the first respondent. Since no adverse order is being passed against the second respondent, notice to the second respondent is dispensed with by this Court.
7.Accordingly, this writ petition is disposed of and the impugned order dated 22.12.2025 passed by the first respondent is hereby quashed and the matter is remanded back to the first respondent for fresh consideration, on merits and in accordance with law. The petitioners shall submit a written
explanation to the first respondent along with the supporting documents, stating as to how the petitioners will fall under the IDLS scheme, within a period of two weeks from the date of receipt of a copy of this order. On receipt of the said written explanation from the petitioners, the first respondent shall take a final decision, after giving due consideration to the written explanation submitted by the petitioners and the supporting documents produced by the petitioners, within a period of four weeks thereafter as to whether the petitioners fall under the IDLS scheme or not. In case the first respondent decides to reject the petitioners' application, the first respondent shall pass a speaking order, after giving due consideration to the written explanation submitted by the petitioners as well as the supporting documents produced by the petitioners. The petitioners shall be afforded an opportunity of hearing by the first respondent before passing the final order. Consequently, connected WMP is closed.
