Common Prayer: Criminal Original Petitions are filed under Section 482 of Criminal Procedure Code, pleased to call for the records of respondent police relating to Crime Nos.542 & 44/2023 and quash the same so far as the petitioner herein.

For Petitioner in both cases : Mr.G.Mohanakrishnan For R1 in both cases : Mr.S.Udayakumar Government Advocate(Crl.Side) COMMON ORDER The petitioner herein is facing two criminal cases, one is registered by the Redhills police in Crime No.542 of 2023 dated 10.06.2023 for offence under Sections 419, 465, 468, 471, 420, 294(b), 307, 506(ii) IPC and Section 25(1)(a) of Arms Act, 1959 and the other case is registered in Crime No.44 of 2023 by Avadi Central Crime Branch dated 14.07.2023 for the offence under Sections 120B, 419, 465, 468, 471 & 420 IPC.

The sum and substance of the petition seeking quash of both the complaints is that it is a motivated complaint against the petitioner by a political leader of the party to deactivate him from participating in the election. The petitioner was harassed by the police by registering two 2/5

cases by the two different agencies.

The learned Government Advocate (Crl.Side) appearing for the respondent police submits that in the real estate dealing, the complaint of cheating and intimidating using fire arms was received leading to registration of a complaint in Crime No.542 of 2023 and a similar case of cheating was received from one Subbarayalu leading to registration of case in Crime No.44 of 2023 by CCB, Avadi, alleging that the petitioner is an History Sheeter and the petitioner is having 49 cases against him which are of grave nature, also submitted that one of the accused had unauthorizedly used the fire arms to intimidate the defacto complainant in Crime No.542 of 2023.

Considering the gravity of the complaint, this Court is not inclined to entertain the petitions to quash the FIR. However, taking note of the pendency of the cases for nearly 10 months, the respondent police are directed to complete the investigation preferably within a period of three months and file a final report.
