This Criminal Original Petition has been filed seeking to challenge the order dated 02.11.2021 made in C.M.P.No. 6003 of 2021 in S.T.C.No.3279 of 2016 on the file of Judicial Magistrate No.II, Pollachi.

2. On perusal of the order of learned trial court, it is clear that the petitioner has repeatedly filed petitions for recall of P.W.1 for cross-examination from the year 2018 and despite the petitions are dismissed, filing of another such petition itself clearly indicates that all these petitions have been filed only to protract the proceedings before the trial court. Such being the position, when this Court is about to dismiss this petition, the learned counsel for petitioner seeks permission to withdraw this petition. Original Petition is dismissed as withdrawn and the trial court shall dispose of the case within a period of three months from the date of receipt of copy of this order.
