J U D G M E N T

(Delivered by S.S.SUNDAR, J.) Though this Court had granted sufficient time to implead the legal heirs of the deceased sole appellant, the learned counsel for the appellant has not taken steps in regard thereto. The reason assigned by the learned counsel for the petitioner is that he is unable to reach out the legal heirs of the deceased appellant.

2. However, the learned counsel for the appellant produced the death certificate of the appellant before this Court. Therefore, the stand taken by the learned counsel for the appellant that he is unable to reach out the legal heirs of the deceased sole appellant, does not cut ice with this Court.

3. Therefore, this Court is not inclined to grant further time without any cause and this appeal stands dismissed for non-prosecution i.e., for not taking steps to implead the legal heirs of the deceased appellant. However, it is open to 2/4

the legal heirs of the deceased appellant to come on record by filing an appropriate petition. No costs.
