Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a writ of mandamus directing the respondent to consider the petitioner's representation dated 19.04.2021 and direct the respondent to provide access to the petitioner's property by opening southern end of the compound wall which is preventing the petitioner's entry to the common public pathway.

O R D E R

(The case has been heard through video conference) The relief sought for in the present writ petition is to direct the respondent to consider the petitioner's representation dated 19.04.2021 and to provide access to the petitioner's property by opening southern end of the compound wall which is preventing the petitioner's entry to the common public pathway.

2. The learned counsel for the petitioner would submit that the petitioner gave a representation dated 19.04.2021 to the respondent in person, however, the same was not yet considered by the respondent. He would further submit that it is suffice that if the petitioner's representation is duly considered by the respondent and appropriate orders are passed therein. https://hcservices.ecourts.gov.in/hcservices/

3. Mr.Subbarayalu, learned counsel takes notice for the respondent. He would fairly submit that if the petitioner makes a fresh representation before the respondent, then the same will be duly considered by the respondent and appropriate orders will be passed therein, within a time frame, as stipulated by this Court.

4. Heard the learned counsel on both sides.

Considering the submissions made by the learned counsel on both sides, this Court without expressing any opinion on merits of the case, issues the following directions: (i) The petitioner is directed to submit a fresh representation to the respondent within a period of one week from the date of receipt of a copy of this order. (ii) On receipt of such representation, the respondent is directed to consider the same and pass appropriate orders on merits and in accordance with law, as expeditiously as possible.

6. This Writ Petition is disposed of with the above directions. No costs.
