.. Respondents Prayer: Petition under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus, directing the respondents to provide employment assistance to petitioner on compassionate ground by considering the petitioner's representation dated 18.05.2015.

ORDER

The father of the petitioner, who was working as a Lineman in the respondent establishment, died in harness on 08.09.1992. The mother of the petitioner gave various representations to the respondents for providing compassionate appointment to the petitioner.

2. However, due to the pendency of Civil Suit in O.S.No.892 of 1993 before the learned District Munsif, Gudiyattam, Vellore District, that is instituted by one Selvi and others against the petitioner's mother claiming that they are the legal heirs of the father of the petitioner, there is impediment in granting appointment. However, the said suit was dismissed on 07.12.2006. https://hcservices.ecourts.gov.in/hcservices/

Thereafter, the terminal benefits payable due to the death of the father of the petitioner were paid to the mother of the petitioner on 05.05.2008. While so, a representation is made by the mother of the petitioner to the second respondent for providing compassionate appointment to the petitioner.

Learned counsel for the petitioner has brought to my notice that the third respondent sent a proceedings in Lr.No.37/Ni.Pi.2/Ni.Vu.2/Ko.Ma.A.Tha/2010, dated 27.04.2010 that the request of the mother of the petitioner for compassionate appointment could be considered, after getting appropriate orders from the second respondent.

4. In these circumstances, the Writ Petition is disposed of by directing the third respondent to pass orders on the request of the mother of the petitioner for compassionate appointment as stated in the proceedings of the third respondent dated 27.04.2010, within a period of eight weeks from the date of receipt of a copy of this order.
