A.DAMODARAN, ADDITIONAL PUBLIC PROSECUTOR PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioners apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 406, 420, 468, 471 & 506 (ii) of IPC, in Crime No.154 of 2022, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner have collected huge sum of money from the general public by giving false promises that he would make the victims as one of the beneficiary through the trust which he has created , or said to have been created large volume of foreign currency to the tune of Rs.1,400 crores in favour of the said trust through the RBI. On the false assurance, other victims believed the words of the defacto complainant and deposited with the accused. Thereafter, it was found that the entire documents produced by the accused are false and fabricated one, thereby cheated the general public. Hence, this complaint.

3. The learned Additional Public Prosecutor submitted that not only the defacto complainant, there are other victims also produced the statement recorded from the victim.

On perusal of the form produced by the petitioner as currency declaration form which reveals that he running the trust in the name of Omsakthi Group of Traders and Company and he searching for the beneficiaries to distribute the amount which was allegedly received to the tune to Rs.1400 Crores, for which he collected a lot of money from the victims and cheated them. Therefore, the custodial interrogation of the petitioner is very much required in this case and this Court is not inclined to grant anticipatory bail to the petitioner.
