This Civil Miscellaneous Petition has been filed to condone the delay of 172 days in filing the above Civil Miscellaneous appeal.

2. Heard the learned counsel for the petitioner.

3.Mr.Ramprabu, learned representing counsel for Mr.P.Suresh Srinivasan, learned counsel for the second respondent has raised serious objection in allowing this petition.

4. The petitioner would state that due to financial constraints, delay of 172 days occurred in filing the appeal.

5. The reasons mentioned by the petitioner appear to be acceptable and reasonable. Therefore, this petition is ordered and the delay of 172 days is hereby condoned.
