O R D E R

(Order of the Court was made by M.Dhandapani,J.) Petitioner has filed this Public Interest Litigation, seeking for a direction to the first respondent to consider his representation, dated 14.04.2018, by taking appropriate action to hand over Public Examination results of the students of 10th Standard and 12th Standard to the parents/guardians in the Parent-Teacher Meeting in the school premises by giving appropriate counselling.

2. The case of the petitioner is that every year, because of the students getting lower marks in 10th and 12th standards, the Government has to take steps to give counselling to the students and also the parents to avoid suicides.

Learned Special Government Pleader, appearing for the respondents, would submit that nearly ten lakh students are taking part in examinations and 90% of the students are passing the examinations and some of the students are failing in the examinations. He would further submit that examination results are sent through electronic media, such as, SMS, internet etc.; it is not possible for the Government to give counselling to all the students and it is also not possible to convene ParentTeacher Meetings for furnishing the results; and, therefore, it is for the parents to take care of their children, who take the examinations.

4. We have heard the learned counsel for the parties.

5. At the outset, we are to say, this Writ Petition has been filed as a Publicity Interest Litigation only with a view to gain popularity, and not with a real purpose. The children, who are sensitive to certain issues, have their parents to take them to psychiatric counselling to overcome the situation and the difficulties; to develop confidence in the educational activities; and not to get frustrated. In other words, it would be the utmost duty of the parents to take care of their children, who are very sensitive to such kind of situations, confronting them. In the considered opinion of this Court, no public interest is involved in this Writ Petition to cast the obligation on the part of the State to take measures in this regard. Normally, health check-up would be conducted in every school, involving sensitivity in mental activities. During the course of regular medical check-up, if any deficiency is found in any of the students, their parents would be advised to take care of their children to extend special care and bring confidence in them. The problem of the present kind will be

solved only by the parental care of the children so as to develop confidence in the educational system as well. It is not the duty on the part of the Government to extend such activities, rather, it is the duty of the parents to take care of their children to face the situation and to develop confidence in them so as to enable them to secure good marks. The Government is conducting re-examination within a month by changing the earlier pattern. Moreover, there is no loss of academic year and, hence, the Government has taken sufficient care in this regard. For the students who are very sensitive, the parents have to take care of the situation to develop their mental health.

6. With the above observations, this Writ Petition is disposed of.

No costs.

Consequently, the connected W.M.P.No.14151 of 2018 is closed.
