Ajay Justice Shaw v. Dr.Keerthi
and O.P. No. 308 of 2024 C.V.KARTHIKEYAN, J.
This application has been filed by the father of a young infant, which is just aged 1 1⁄2 years, seeking permission to interact with the minor infant through video conference. The child is now under the custody of the respondent /mother.
2. When the matter came up for hearing on 06.06.2024, after hearing the learned Senior Counsel appearing on behalf of the applicant and the learned Senior Counsel appearing on behalf of the respondent, this Court had thought that it would be a good arrangement if the father were to interact through video conference with the child on every Monday, Wednesday and Saturday between around 6.00 p.m. to 6.30 p.m.
3. It is today expressed that making the child to sit for half an hour practically on every alternate days is a very hard task for the mother and child also, since the interest of the child would be varied and he would like to explore around rather than sitting in one place.
4. Taking into consideration all aspects, a slight modification is done with the order dated 06.06.2024. The interaction through video with the child would be on every Wednesday and Saturday between 6.00 p.m. and 6.30 p.m. and on every alternate Mondays, apart the Wednesdays and Saturdays, which had been indicated above again between 6.00 p.m. and 6.30 p.m.
5. To clarify, every week it would be Wednesdays and Saturdays between 6.00 p.m. and 6.30 p.m. and apart from that, every fortnight Mondays again between 6.00 p.m. and 6.30 p.m.
6. Recording the above, giving liberty to both parties to move fresh application if modification is required of this arrangement, Application No. 2426 of 2024 is closed.
