Order : This petition coming on for orders upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of M/S.CHANDRAKUMAR L., Advocate for the petitioner and of MR.M.RAJENDIRAN, Advocate for the 1st respondent and of MR.BABUMUTHUMEERAN, Advocate for the 2nd respondent, the court made the following order:- This petition has been filed to vacate the interim order made in W.M.P.No.10182 of 2019 in W.P.No.9565 of 2019, dated 01.04.2019. 2.The learned counsel appearing for the petitioner is not ready.

3. The matter relates to the tender for Training the Jewel Appraiser. Alleging that there is a violation of tender condition and mala fide in awarding the tender in favour of the 2nd respondent, the present writ petition is filed. https://hcservices.ecourts.gov.in/hcservices/

4. At the time of admission, interim order has been granted.

5. The first respondent has filed this petition to vacate the interim order placing the facts before this Court that the petitioner herein, having participated in the tender, has lost the bid and the 2nd respondent was the successful bidder and the tender was offered to him vide order dated 25.02.2019. The 2nd respondent has started imparting training from 04.03.2019. Whereas the interim order was passed on 01.04.2019. After the successful bidder commenced the classes and the training was underway due to the interim order, the training could not get completed and the first respondent who is the requisite body of the jewellery assessor is under peril and inconvenience.

6.On perusing the records, this Court finds that by virtue of interim order, the training has come to an halt and the first respondent is highly prejudiced by that.

7.Considering the balance of convenience, the interim order already granted by this Court on 01.04.2019 is vacated. Post the main writ petition after four weeks. -sd/- 20/11/2019 / TRUE COPY / Sub Assistant Registrar ( Statistics / C.S. ) High Court, Madras - 600 104.
