ORDER

Today, when the matter is called for hearing, the learned Senior Central Government Standing Counsel appearing for the appellant submitted that appeal lies only before the Court of Sessions, against the order impugned in this appeal and seeks permission of this Court to withdraw the appeal and file the same before appropriate forum and he has also made an endorsement to that effect. Recording the submissions made by the learned Senior Central Government Standing Counsel and the endorsement made, this criminal appeal is dismissed as withdrawn with liberty to the appellant to file an appeal before the appropriate forum. The period spent for this appeal shall be exempted for the purpose of calculation of limitation.
