Writ Petition is filed under Article 226 of Constitution of India praying to issue a Writ of Mandamus directing the 2nd and 3rd respondents to pay sum of Rs.5,00,000/- as a compensation for illegally acquired the petitioner land an extension of 6 cents and destroyed sugar cane cultivated by the petitioner an extension of 15 cents for put of mud 1/4

road for 15ft width and 80ft length in the petitioner land and consequently directing the 2nd and 3rd respondents to remove the public road put up by the 2nd and 3rd respondents in the petitioner patta land comprised in S.No.5/1F situated at Mallappanayakkan Palaiyam Village, Kalasappaakkam, Sub Registration Office, Thiruvannamalai Taluk & District and with in time frame limit.

ORDER

This writ petition has been filed for direction to the 2nd and 3rd respondents to pay sum of Rs.5,00,000/- as a compensation for illegally acquired the petitioner's land to an extent of 6 cents and destroyed sugar cane cultivated by the petitioner to an extent of 15 cents for putting of mud road of 15ft width and 80ft length in the petitioner's land and consequently to direct the 2nd and 3rd respondents to remove the public road put up by the 2nd and 3rd respondents in the petitioner's patta land comprised in S.No.5/1F situated at Mallappanayakkan Palaiyam Village, Kalasappaakkam, Sub Registration Office, Thiruvannamalai Taluk & District.

It is seen that while pending the writ petition, the petitioner himself gifted the subject land for using as road by general public and for the said land, the petitioner was compensated with 'Thoppu Poramboke' admeasuring 9 cents, in which the petitioner put up a hut for his cattle and he is living there.

Recording the above submissions, this writ petition is closed. There shall be no order as to costs.
