Petition praying that in the circumstances stated therein and in the Memorandum of Grounds in CRL.A.No.511 OF 2022 on the file of the High Court, the High Court will be pleased to suspend the sentence of imprisonment imposed on the petitioner by judgment dated 27.04.2022 and made in C.C.No.7/2014 on the file of Learned Special Judge Under Prevention of Corruption Act the Special Court for the cases under Prevention of Corruption Act at Chennai-104 and enlarge the petitioner on bail pending disposal of the above CRL.A.No.511 OF 2022.
Order : This petition coming on for orders upon perusing the petition and the Memorandum of Grounds in CRL.A.No.511 OF 2022 on the file of the High Court and upon hearing the arguments of M/S.C.SUNDARESAN,Advocate for the petitioner and of THE PUBLIC PROSECUTOR on behalf of the Respondent the court made the following order:-
This petition has been filed seeking for to suspend the sentence imposed by the Court below convicting the petitioner for offence under Section 7 of Prevention of Corruption Act and sentencing to undergo RI for one year and to pay a fine of Rs.1000/- and in default to undergo three months SI, and further convicted the petitioner for offence under Section 13(2) read with Section 13(1)(d) of the Prevention of Corruption Act, sentencing him to undergo two years RI, and to pay a fine of Rs.1000/- and in default to undergo three months SI.
2. Taking into consideration the materials available on record and the grounds raised by the petitioner, this Court is inclined to suspend the substantive sentence imposed against the petitioner subject to the following conditions.
(a)The petitioner shall deposit the entire fine amount imposed by the Trial Court, if not already deposited.
(b)The petitioner shall execute a bond for a sum of Rs.5,000/- (Rupees Five Thousand only) along with two sureties each for a like sum, and (c)The petitioner shall appear before the learned Special Judge, Special Court for the Cases under Prevention of Corruption Act, Chennai, on the first working day of every month at 10.30 A.M., until further orders.
3. This Criminal Miscellaneous Petition is disposed of accordingly.
