ORDER

The present criminal original petition has been filed seeking a direction to the respondent police not to harass the petitioner under the pretext of enquiry based on the complaint lodged by the de facto complainant.

2. It is the case of the petitioner that based on the complaint given by one Dr.Dyvasirvadam, CSI, Bishop Incharge, the respondent police is frequently calling the petitioner under the guise of enquiry and harassing him. Hence, the petition.

3. Learned Additional Public Prosecutor submitted that based on the complaint given by the said Dr.Dyvasirvadam on the allegation of cheating, the respondent is conducting enquiry and only for the purpose of enquiry, the petitioner was called by the respondent police and absolutely, there is no harassment and without appearing for enquiry, the petitioner has approached this Court by filing the present petition.

4. Considering the submissions made by the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor, this Court is constrained to pass the following order:- (i) The petitioner is directed to cooperate with the enquiry.

(ii) The respondent police is directed to conduct the enquiry in accordance with law, without harassing the petitioner.

5. The criminal original petition is ordered accordingly.
