ORDER
The Writ Petition has been filed by the petitioner seeking a direction to the 1st and 2nd respondents to immediately investigate into the complaints and take necessary action against one M.Kannadasan (an Advocate) who is continuously restraining the petitioner from his properties in survey numbers 96/5 (0.81 Cents), 96/6 (0.29 Cents), 140/1, 140/7, 140/10, 141/1, 141/3, 141/9, 142/4 situated in Tirur Village, Tiruvallur district. 2.The petitioner had sent a complaint to the Commissioner of Police, Avadi on 22.11.2025, which was forwarded to the second respondent. Since no action has been taken, the present petition is filed. 3.The contention of the learned counsel for petitioner is that the petitioner is the absolute owner of properties in S.Nos.96/5 (0.81 Cents), 96/6 (0.29 Cents), 140/1, 140/7, 140/10, 141/1, 141/3, 141/9, 142/4 situated in Tirur Village, Tiruvallur district. These properties originally owned by one M.V.Krishnaswamy, who executed a Will dated 26.07.1927 in favour of his 8 legal heirs. The petitioner purchased the property from one of the legal heirs and
submitted for registration at SRO, Manavalan Nagar. The registration was denied on 10.10.2023 for the reason that there was an injunction granted in O.S.No.158 of 1989 by the learned District Munsif, Tiruvallur and it was a partition suit between the legal heirs of Late.Krishnaswamy. Thereafter the petitioner filed W.P.No.929 of 2024 before this Court and this Court quashed the refusal notice dated 10.10.2023 and finding that suit was disposed on 22.09.2023 itself, directed the registrar to allow registration of the document, if there is no other legal impediment. Again the registration was denied on the ground that one Kannadasan, one of the legal heirs of C.Munuswamy raised his objections and filed W.P.No.38349 of 2024 before this Court against the SubRegistrar, Manavalan Nagar and the same was ordered in favour of the petitioner. It is Kannadasan, an Advocate and legal heir of Munuswamy, the labour contractor appointed by Mr.M.V.Ramamurthy causing and threatening the petitioner using unparliamentary words. Hence, lodged a complaint but no action has been taken.
4.The learned Government Advocate (Crl. Side) submitted that the complaint sent to the Commissioner of Police received in COP No.13112164 and fairly submitted that the counter petitioner alone was called for enquiry and the petitioner was not called for enquiry.
5.In view of the above, the second respondent is directed to continue with the enquiry, call the petitioner and the counter petitioner and any objectors and thereafter to take the complaint to its logical end. The entire exercise to be completed within a period of four weeks from the date of receipt of a copy of this order.
