ORDER
The petitioner has filed this writ petition for a Mandamus, to direct the third and fourth respondents to promote him as
Special Sub Inspector of Police with effect from 28.10.2019.
2. The case of the petitioner is that he was subjected to disciplinary proceedings and thereafter dismissed from service on 04.01.2000. The order of dismissal was challenged before the erstwhile Tamil Nadu Administrative Tribunal, Chennai and by an order dated 14.01.2003, the dismissal order was modified to stoppage of increment for two years with cumulative effect without affecting the backwages and services of the petitioner.
3. The petitioner was thereafter absorbed into service on 10.10.2003 and was promoted as Grade I Police Constable on 15.01.2005. Due to these factors, the respondents have not given promotion to the petitioner as a Special Sub Inspector of Police with effect from 28.10.2019.
4. The petitioner appears to have sent a representation dated 06.12.2019 to the respondents. The respondents have not passed any order and it is under these circumstances, the present writ petition has been filed.
5. Considering the above facts, this Court is inclined to dispose this writ petition by directing the third respondent to consider the petitioner's representation dated 06.12.2019 and pass appropriate orders within a period of three months from the date of receipt of a copy of this order in accordance with law and on merits.
6. This Writ Petition stands disposed of with the above observations. No costs.
