Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus directing the respondents 1 to 4 to transfer the E.B connection in S.C.No.578-012-822 (5 HP) from the Well in S.F.No.70/1B owned by the 8th respondent to the petitioner's Well in S.F.No.73/6 of A.Kolathur Village, Ulundurpet Taluk, Kallakurichi District in terms of the recitals in the sale deed dated 23.03.2017 (Doc. No.433/2017) executed by the respondents 5 to 7, by considering the petitioner's representations dated 30.07.2020 and 29.03.2021 and pass orders.

The Writ Petition has been filed seeking direction to the respondents to consider the petitioner's representations dated 30.07.2020 and 29.03.2021.

2.The facts of the case are as follows:

The respondents 5 to 7 are the original owners of the property measuring an extent of 44 cents in S.F.No.73/6, A.Kolathur Village. The fifth and sixth respondents' father had applied for electricity service connection. Pending application, the petitioner purchased the said property from the respondents 5 to 7 vide sale deed dated 23.03.2017. By suppressing the transfer of the proposed Service connection in S.F.No.73/6, they obtained a new service connection to another well in S.F.No.70/1B in the name of eighth respondent. The petitioner has approached the fourth respondent with relevant documents and information received from RTI, but he has given evasive reply. Hence, the petitioner made representations dated 30.07.2020 and 29.03.2021 to the respondents 2 to 4 seeking the above said remedy.

3. The learned counsel for the petitioner submitted that it would suffice, if this Court issues a direction to the respondents 1 to 4 to consider the petitioner's representations and pass appropriate orders within the stipulated time as fixed by this Court.

4. On the other hand, the learned Standing Counsel for the 3/6

respondents submitted that the respondents 1 to 4 will consider the representations of the petitioner and pass appropriate orders on merits within the time frame to be fixed by this court.

5. Heard, the learned counsel for the petitioner and the learned counsel appearing on behalf of the respondents 1 to 4 and perused the materials available on record.

6. Considering the facts and circumstances of the case and having heard the submissions made by the learned counsel on either side, the respondents 1 to 4 are directed to consider the petitioner's representations dated 30.07.2020 and 29.03.2021 and pass appropriate orders on merits and in accordance with law, within a period of four weeks from the date of receipt of a copy of this order.

7. With the above direction, the writ petition stands disposed of. Consequently, connected Miscellaneous Petition is closed. No costs. 01.09.2025 dh Index : Yes/No Internet : Yes/No 4/6
