Petition praying that in the circumstances stated therein the High Court will be pleased to modify the order dated 30.11.2017, as far as the condition to deposit the sum of Rs.1,00,000/- (Rupees one lakh only) to the credit of C.C.No.126 of 2011, order dt.27.09.2017 on the file of the Special Court for the case under Prevention of Corruption Act at Chennai.

Order : This petition coming on for orders upon perusing the petition and upon hearing the arguments of M/S.G.THANGAVEL, Advocate for the petitioner and of MR. P.GOVINDARAJAN, ADDL. PUBLIC PROSECUTOR on behalf of the Respondent the court made the following order:- This petition has been filed to modify the order dated 30.11.2017, as far as the condition to deposit a sum of Rs.1,00,000/- (Rupees one lakh only) on the file of Special Court for the case under Prevention of Corruption Act at Chennai.

2. This Court, on 30.11.2017 in Crl.M.P.No.15041 of 2017, has passed an order suspending the sentence imposed on the petitioner on the following conditions:- i) the petitioner shall deposit a sum of Rs.1,00,000/- (Rupees One Lakh only), to the credit of C.C.No.126 of 2011 on the file of the Special Court for the cases under Prevention of Corruption Act at Chennai within a period of three weeks from the date of the receipts of a

copy of this Order and also ii) the petitioner shall execute a bond for a sum of Rs.10,000/- (Rupees Ten thousand only) with two sureties each for a like sum to the satisfaction of the Special Court for the cases under Prevention of Corruption Act at Chennai, within the said period and also iii) the petitioner shall appear before the said trial Court on the first working day of every English calendar month, at 10.30 am, until further orders.

Now, the learned counsel appearing for the petitioner seeks to modify the first condition viz., to deposit a sum of Rs.1,00,000/- to the effect that the petitioner shall execute a bond for a sum of Rs.1,00,000/- (Rupees one lakh only) with two sureties each for a like sum to the satisfaction of the Special Court for the cases under Prevention of Corruption Act at Chennai, within the period of two weeks from the date of receipt of a copy of this order. It is further submitted that the second condition viz., the petitioner shall execute a bond for Rs.10,000/- may be deleted.

Considering the submissions made by the learned counsel for the petitioner, the bail condition imposed in the order dated 30.11.2017 in Crl.M.P.No.15041 of 2017 is modified as follows:- i) the petitioner shall execute a bond for a sum of Rs.1,00,000/- (Rupees one lakh only) with two sureties each for a like sum to the satisfaction of the Special Court for the cases under Prevention of Corruption Act at Chennai, within the period of two weeks from the date of receipt of a copy of this order and ii) the petitioner shall appear before the said trial Court on the first working day of every English calendar month, at 10.30 am, until further orders.
