O R D E R

The prayer in the writ petition is to direct the respondents 2 & 3 to remove the Commercial Electricity Connection No.02498007335 and its meter relating to the 4th respondent Hollow Brick Industry situated at Avalurpettai Village, Melmalaiyanur Taluk, Villupuram District, from the petitioner's land in Survey No.69/5B2.

The grievance of the petitioner is that while the connection is sought and is given with reference to the 4th respondent's land in Survey Nos.69/5A1 and 69/5B1, actually the meter and the boxes are located in the petitioner's land. Therefore, he seeks to remove the same and locate it only in the 4th respondent's land.

When the matter came up for hearing, Mr.V.Venkata Seshaiya, Learned Counsel taking notice on behalf of the respondents 1 to 3 would submit that after the complaint of the petitioner, the authorities inspected the site. The 4th respondent objects to the claim of the petitioner and claims that the place in which the meter stands is only within his land in Survey Nos.69/5A1 and 69/5B1. In this regard, the authorities have written to the jurisdictional Surveyor to conduct a joint inspection and depending on the outcome of the survey, further action will be taken.

4. In view of the said reply that is made, this writ petition is disposed of at the admission stage without notice to the private respondent. (i) The said join inspection be conducted in the presence of both the petitioner as well as the 4th respondent, depending on the outcome of the survey, the Authority shall decide as to the shifting of the meter box and the other materials that are said to be installed in the particular place. (ii) The aforesaid exercise shall be completed within a period of twelve (12) weeks from the date of receipt of the web copy of the order. A copy of this order shall also be brought to the notice of the jurisdictional 3/5

Tahsildar, who shall instruct the jurisdictional surveyor to complete the survey at the earliest possible time.

There shall be no order as to costs.
