ORDER
This criminal original petition has been filed to set aside the order dated 20-2-2026 in Crl M.P. No.3 of 2026 in Crl Appeal No.187 of 2025 on the file of the III Additional District and Sessions Court, Tiruvallur at Poonamallee. Consequently, grant extension of time to comply with the condition order dated 16-9-2025 in Crl M.P. No.1 of 2025 in Crl Appeal No.187 of 2025 by the Principal District and Sessions Judge, Tiruvallur. 2.It is seen that the petitioner/accused was convicted under Section 138 NI Act by the trial Court in S.T.C No.148/2024 by judgment dated 21.08.2025, wherein, one of the conditions is that the petitioner to pay twice the cheque amount as compensation. Aggrieved against the same, the petitioner preferred an appeal before the Principal District and Sessions Court in Crl.A.No.187 of 2025 along with Crl.M.P.No.
1 of 2025. The Sessions Court admitted the appeal, suspended the sentence, and directed the petitioner to pay 10% of the compensation amount within a period of 60 days from 16.09.2025. Thereafter, the petitioner, for some reasons, could not mobilize the amount. Hence, the petitioner filed a miscellaneous petition in Crl.M.P.No.03 of 2026 seeking extension of time, which came to be dismissed by the Sessions Court. Challenging the same, the present petition has been filed.
3.Now, the petitioner is ready to pay the compensation amount and is willing to comply with the order of the Sessions Court. However, since the time granted has already exhausted, the trial Court is not accepting the deposit. 4.In view of the above, the petitioner is directed to deposit the compensation amount as ordered by the Sessions Court within a period one week from the date of upload of this order. Accordingly, the criminal original petition is disposed of. Consequently, connected miscellaneous petition is closed.
