Respondent Prayer : Writ Petition filed under Article 226 of the Constitution of India, pleased to issue a Writ of Mandamus directing the respondent herein to settle the retirement benefits payable to the petitioner herein by taking his 33 years of meritorious service rendered in the respondent corporation from 01.12.1986 to 29.02.2024, by considering the representation of the petitioner, dated 13.03.2024.

This petition is filed seeking a direction to the respondent to settle the retirement benefits payable to the petitioner herein by taking his 33 years of meritorious service rendered in the respondent Corporation from 01.12.1986 to 20.02.2024 by considering the representation of the petitioner, dated 13.03.2024.

2. The case of the petitioner is that the petitioner joined the second respondent Corporation on 01.12.1986 and he was regularised in service with effect from 01.12.1990. While so, upon attaining the age of superannuation, the petitioner retired from service on 29.02.2024. Immediately, after retirement, the petitioner became sick and is currently undergoing treatment at Vel Tech Hospital. On account of the financial crunch, the respondent Corporation is not settling any of the retirement benefits. Therefore, the petitioner has come up with the Writ Petition.

3. Mr.L.S.M.Hassan Fizal, learned Additional Government Pleader for the respondent submits that the retiral benefits will be settled to the petitioner within a reasonable time.

4. Considering the overall facts and circumstances of the case, this Writ Petition is disposed of with the following order :- (i) The respondent shall disburse all the retiral benefits of the petitioner within three months from the date of receipt of a copy of this order;

(ii) The respondent shall also consider releasing anyone of the benefits immediately to the petitioner as it is stated that he is in the Hospital and the same shall be done within 15 days from the date of receipt of a copy of this order;

(iii) There shall be no order as to costs.
