Respondents PRAYER: Writ petition filed under Article 226 of the Constitution of India praying for issuance of Writ of Mandamus to direct the 3rd respondent and 4th respondent herein to consider the petitioner's patta application vide its acknowledgement receipt No.6666600299 and consequently survey the land and issue patta in favour of the petitioner within a period fixed by this Court.

Mr.P.V.Selvakumar, learned Additional Government Pleader, takes notice for the respondents. By consent of the parties, the main writ petition is taken up for final disposal at the admission stage itself.

2. Heard the learned counsel for the petitioner and the learned Additional Government Pleader appearing for the respondents.

3. The petitioner seeks for a direction to the 3rd respondent to consider his application dated 21.12.2016 seeking for transfer of patta. The grievance of the petitioner is that the said application has not been disposed of so far.

4. Needless to say that the 3rd respondent, namely, Tahsildar, Ayyanavaram Taluk is to consider the said request of the petitioner and pass orders on the same on merits and in accordance with law without loss of further time. Accordingly, this writ petition is disposed of without expressing any view on the merits of the claim made by the petitioner only with a direction to the 3rd respondent to consider the application of the petitioner dated 21.12.2016 and pass orders on the same on merits and in accordance with law after giving due opportunity of hearing to the rival claimants, if any. Such exercise shall be done by the 3rd respondent within a period of four weeks from the date of receipt of a copy of this order. No costs.
