W.P.Nos.2269 of 2015 to 2281/2015:
Petition filed under Article 226 of the Constitution of India praying to issue a writ of mandamus, directing the respondent to consider the petitioners' representation dated 13.12.2014 to pay the enhanced dearness allowance on the basis of the rise in points from 01.10.2014 with reasonable interest.
For Petitioner : Mr.D.Sivashanmugam For Respondents : Mr.R.Balar Ramesh, Additional Government Pleader
ORDER
The petitioners are working in different capacities in the canteen maintained by the respondent. The respondent passed an order dated 19.07.2011 fixing the salary of the employees employed in the catering establishment. The petitioners have been given Dearness allowance and similar other allowances pursuant to the decision taken by the respondent.
2. It is the grievance of the petitioners that the order dated 17.10.2014 fixing the Dearness allowance on the basis of 5848 points has not been followed in their case. The petitioners have given representation on 13.12.2014 requesting the respondent to extend the benefits of the order dated 17.10.2014. Since there was no follow-up action taken by the respondent, the petitioners are before this Court.
3. The question as to whether the petitioners are entitled to the benefits of the order dated 17.10.2014 is an essential issue to be decided by the respondent.
4. The respondent is directed to consider and dispose of the representation dated 13.12.2014 on merits as per law. Such exercise shall be completed within a period of two months from the date of receipt of a copy of this order.
5. The Writ petitions are disposed of with the above direction. No costs.
